Law 8/2006 – Retired members

The Ministry of Culture has communicated the list of creators’ unions legally established and recognized as legal entities of public utility, whose beneficiaries can obtain the indemnity based on Law No. 8/2006, a list that includes a number of 8 unions, namely:

  • Romanian Writers’ Union;
  • Union of Composers and Musicologists of Romania;
  • Union of Visual Artists of Romania;
  • The Romanian Theatre Union;
  • Romanian Filmmakers Union;
  • Union of Interpretive Creation of Musicians from Romania;
  • Union of Authors and Filmmakers of Romania;
  • Union of Architects of Romania.

 

Useful information for beneficiaries / potential beneficiaries of the rights provided for by Law No. 8 / 2006

The monthly allowance provided for by Law No. 8/2006 shall be granted to pensioners of the public pension system who are members of creators’ unions legally established and recognized as legal entities of public utility, according to the provisions of Government Ordinance No. 26/2000 on associations and foundations, approved with amendments by Law No. 246/2005 and who:

  • are Romanian citizens, foreigners or stateless persons;
  • have their domicile or residence in Romania, or, as the case may be, abroad.

 

The categories of pensioners of the public pension system provided for by Law no. 19/2000 on the public pension system and other social insurance rights, with subsequent amendments and supplements, are:

  • old-age pensioners;
  • retirees with early and partial early retirement;
  • disability pensioners, regardless of the degree of disability;
  • surviving pensioners.

The amount of the monthly allowance provided by law represents 50% of the pension due or, as the case may be, in payment at the date of the request, but cannot exceed two minimum gross basic salaries per country, guaranteed in payment.

The amount of the allowance changes whenever the holder’s pension changes as a result of a change in the value of the pension point.

The monthly allowance is not granted to persons who benefit from the allowance granted under Law no. 118/2002 for the establishment of the merit allowance.

 

When does the payment of the compensation provided for by the special law cease?

The payment of the allowance ceases starting with the month following the month in which:

  • the beneficiary has died;
  • the beneficiary no longer meets the legal conditions for granting the monthly allowance;
  • the beneficiary loses his/her membership in the creators’ union;
  • the beneficiary has established his/her domicile on the territory of another state with which Romania has concluded a social security agreement, if it is stipulated within it that the monthly allowance is paid by the other state.
  • the holder benefits from the merit allowance pursuant to Law no. 118/2002;

Legally established creators’ unions are required to notify the territorial pension funds in writing whenever changes occur that may lead to the granting or cessation of the monthly allowance, within 15 days from the date of their occurrence.
